Terms of Service

1. Acceptance of Terms

By accessing or using Superforms (“Service”) at https://www.superforms.in, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms constitute a binding agreement between you and Superforms.

2. Description of Service

Superforms is an AI-powered online form builder that lets you create, publish, and analyze forms. Features include a drag-and-drop builder, AI-assisted question generation, design themes, analytics, and optional integrations (including Google Sheets).

3. Accounts

• You must be at least 13 years old to create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use Superforms to:

• Collect data from minors without verifiable parental consent.
• Conduct phishing, fraud, or other deceptive practices.
• Distribute spam, malware, or illegal content.
• Violate any applicable law or regulation.
• Infringe the intellectual property rights of others.
• Harvest personal data without the knowledge or consent of respondents.

We reserve the right to suspend or terminate accounts that violate these terms without notice.

5. Google Sheets Integration

The Google Sheets integration is an optional feature that, when enabled, allows Superforms to write form submission data to a Google Sheets spreadsheet you designate. By enabling this integration you authorize Superforms to:

• Access and modify the specific spreadsheet(s) you select.
• Store an OAuth refresh token to maintain the connection on your behalf.

You can revoke this authorization at any time from your Google Account permissions. Superforms’ use of Google user data complies with the Google API Services User Data Policy.

6. Your Content

You retain ownership of all forms, questions, and response data you create or collect through Superforms. By using the Service, you grant Superforms a limited license to store, process, and display your content solely to provide the Service to you. We do not claim ownership of your data.

7. Subscription & Billing

Superforms offers a free tier and paid Creator plans. Paid plans are billed monthly or annually as selected at checkout. All fees are non-refundable except where required by applicable law. We may change pricing with 30 days’ notice. Continued use after a price change constitutes acceptance of the new price.

8. Intellectual Property

The Superforms platform, including its design, code, brand, and AI features, is owned by Superforms and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, Superforms shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) $50 USD.

11. Indemnification

You agree to indemnify and hold Superforms harmless from any claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, or your violation of these Terms.

12. Termination

You may stop using the Service at any time. We may terminate or suspend your account immediately for violations of these Terms, without prior notice or liability. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) will survive.

13. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in India.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
